Terms and Conditions of sale
The following Terms & Conditions of Sale ("Terms & Conditions") govern the legal framework for the online purchase of the NordicSpirit product range, as defined here below. JTI as the owner and operator of nordicspirit.ch has appointed Ch. Margot & Cie S.A., route de Lavaux 235, 1095 Lutry, to perform all logistical tasks in connection with the processing, packaging, shipment and invoicing of the orders placed through the website.
a. Products
All articles from the NordicSpirit product range as well as related products (jointly referred to as “Products”) are sold on the website to smokers and vapers aged 18 or over and resident in Switzerland.
JTI reserves the right to change the range of Products offered at any time or to remove certain Products permanently.
b. Orders
Prior to placing an order, these Terms & Conditions must be accepted. When a user submits an order, a confirmation e-mail will be sent to the user, listing the details of the order and confirming that JTI has accepted the order. At this point in time, the purchase contract shall be concluded, and the order can no longer be changed or canceled. Products will be neither taken back nor exchanged.
c. Minimum and Maximum Order Quantities
Unless stated otherwise on nordicspirit.ch, the following minimum order quantities apply per order:
- 1 can of NordicSpirit nicotine pouches.
Unless otherwise stated on nordicspirit.ch, the maximum value per order is CHF250.00.
d. Product Availability
JTI seeks to ensure optimum availability of the Products offered on the website. However, if any of the ordered Products is no longer available, the user will be notified of the resultant delay to the delivery of the order or the partial or complete cancellation of the order. In the event of a delay, the user has the option of canceling the order and using a credit note for a subsequent order on nordicspirit.ch.
e. Resale

f. Price
All prices stated on the website include VAT. The prices apply at the time when the user places the order.
g. Payment
Users may pay by TWINT, credit card or debit card (Visa, MasterCard, Amex or PostFinance Card). The user’s account is debited when the order is dispatched. After confirmation of an order by JTI, no refund may be made unless the conditions set out below under “Liability and Warranty regarding the Products” are met. nordicspirit.ch uses Secure Socket Layer (SSL) encryption as well as other certified encryption technologies and systems to ensure the security of user data.
h. Free Sample
The free sample offer is subject to availability and can be redeemed once per account only. To use, enter the code online at checkout at nordicspirit.ch. The codes are non-refundable, non-transferable and have no cash value.
i. Delivery
The Products ordered are delivered by mail. Deliveries are limited to Switzerland; no deliveries can be made to other countries.
As a rule, confirmed orders are delivered to the address indicated on the order confirmation. If the user is not present when the delivery arrives, the ordered Products will be placed in the mailbox where possible. If this is not possible, the user will receive a note inviting him or her to collect the delivery from the post office. The order does not become void and cannot be refunded if the package is not collected from the post office within the specified period. JTI may freely dispose of Products which are not collected from the post office and are returned to the sender. However, the user may request re-delivery of Products of the same type and in the same quantity if they are available in stock by paying in advance the return shipping charges and the charges for re-delivery.
Upon receipt of the delivery, the consumer has 48 hours to make a complaint if the Products received do not comply with the order placed. On expiry of this period, the delivered Products are considered to have been accepted.
j. Shipping costs
For product orders worth at least CHF 15.00 there are no shipping costs. For order values below CHF 15.00 shipping costs of CHF 6.60 apply.
k. Delivery Time
As a general rule, orders are delivered within two working days. However, according to circumstances, the delivery time may vary. It is not possible to select a precise time of delivery, nor is it possible to request a specific delivery date.
No deliveries are made on Sundays or on national and cantonal holidays.
l. Exclusion of Liability and Warranty regarding the Products
Any warranty, liability and compensation for damages, including indirect damages or damages of third parties, in connection with the Products is excluded, insofar as is legally permissible and subject to gross negligence or intent.
In particular, no warranty, liability or compensation is assumed for any damages whatsoever due to a lack of delivery capacity or delayed delivery, Product defects, provision of an incorrect delivery address, or theft or other incidents relating to the delivery of the Products.
m. Theft and Use of Products
Following delivery of the Products or their placement in the consumer’s mailbox, JTI assumes no liability in the event of theft or misuse. The user must ensure that the Products can be neither stolen nor used by minors who have not yet reached the age of 18 or by non-smokers or non-vapers.
n. IP Rights
The contents of the website are protected by copyright and trademarks and/or are exclusively owned by JTI. Unless expressly permitted on the website, the users of the website must not make any further use of any of the contents, including the images, names, trademarks and logos featured on the website.
o. Liability and Representations and Warranties regarding the website
JTI expressly reserves the right to change, amend or delete the contents of nordicspirit.ch or the Products offered on the website any anytime and without prior notice.
While JTI seeks to ensure a high availability of the website, JTI neither represents nor warrants that the website will be available, accessible and retrievable at any time without interruptions and breakdowns.
The user is exclusively responsible for the use of the website. Any and all liability for damages, including indirect damages or damages of third parties, which occur in any way during the use of the website or are connected thereto, is excluded, insofar as is legally permissible, and subject to gross negligence or intent. In particular, JTI shall not be liable for damages resulting from (i) lack of due diligence by the user; (ii) the use by unauthorized persons; or (iii) improper use or use in violation of these Terms & Conditions.
p. Applicable Law and Jurisdiction
These Terms & Conditions shall be governed by the substantive Swiss law. The competent courts in Lucerne, Switzerland, have exclusive jurisdiction.
