Social Media Policy

We have created our social media websites to facilitate discussion about us and our activities.

These rules aim to ensure that meaningful, constructive, and transparent conversations take place on our social media. We currently have accounts on Facebook, Instagram, and YouTube.

If you use one of our social media websites, you agree to comply with these rules. You likewise agree to comply with all other terms of use applicable to each platform (e.g. the Facebook Terms of Service YouTube and the Instagram Terms of Use).

Our social media websites are aimed only at smokers and vapers who are at least 18 years of age and are residents of Switzerland.

You hereby acknowledge that you use our social media websites at your own risk. We accept no contractual or non-contractual liability for any losses or damage arising as a direct or indirect consequence of the foregoing, insofar as permitted by law and subject to gross negligence or intent. In particular, we shall not be held liable for losses that are the result of (i) negligent conduct on the part of the user, (ii) use by unauthorized persons, or (iii) improper use or use that violates these rules or the Terms of Use of the platforms.

We reserve the right to change these rules at any time and without prior notice. These rules shall apply exclusively as amended. By using our social media websites, you accept these rules in their most current version. These rules are subject to substantive Swiss law; the exclusive place of jurisdiction is Lucerne, Switzerland.

1.1 Your posts

You are responsible for all of your posts published on our social media. We are not obliged to reply to every post.

We expect all posts to be decent and relevant to the topic under discussion. As a result, your post must not:

discuss political or religious issues;
be offensive, sexually explicit, or pornographic;
be false, inaccurate, misleading, or based on rumors;
be excessively repetitive or considered spam;
be threatening;
be unlawful;
reveal personal data about other persons;
breach the intellectual property rights of any third party (such as copyright, database rights, trade secrets, confidential information, or trademarks);
imitate other persons;
constitute an offer to sell or a solicitation of an offer to buy;
advertise, promote, market, or endorse our products and brands; or
advertise, promote, market, or endorse third-party products, services, or brands.

We may also disclose your identity to a third party, should it claim that the content you have posted on our social media websites breaches applicable law, its intellectual property rights, or its right to privacy.

The views expressed by other users on our social media websites do not represent our views or values.

1.2 Moderation

We monitor our social media websites to ensure that posts are relevant and comply with these rules. We are available on our social media websites to answer any questions you may have.

We are entitled (at our sole discretion) to prevent a post from being published on our social media websites and to remove a post already published on our social media websites, should we determine that a post breaches these rules or any other applicable specific terms of use of a platform. We are under no obligation to notify you of any such decision.

One or more breaches of these rules or other applicable specific terms of use of a platform may result in you being blocked or banned from our social media websites. We are entitled, at our sole discretion, to block or ban accounts on our social media websites.

1.3 Our social-media websites

We do not guarantee that the content published by us on our social media websites is completely correct, complete, or up to date. All of the content published is for information purposes only and is non-binding. No important decisions should be made on the basis of this content without first consulting more accurate, complete, and up-to-date sources of information. The content on our social media websites is to be used at your own discretion and risk. Our social media websites may contain historical information that is not necessarily up to date and is provided to you as a reference only.

If we “follow”, “like” or “share” something or perform a similar action, does not in any way constitute support for the post.

Although our official social media websites are located on external social media platforms, this does not mean that we support these platforms or take responsibility for their products and services.

Your use of external social media platforms is at your own risk and excludes any liability on our part for loss or damage of any kind.

You are entitled to share the content posted by us provided you do not modify it and you only share it with smokers and vapers who are at least 18 years of age and resident in Switzerland.

1.4 Intellectual Property Rights

We respect the intellectual property rights of others and expect the same respect from you. You warrant that the content you post on our social media websites has been created by you alone, or if such content is subject to an intellectual property right of a third party, you warrant that the owner has granted you permission to use such content in accordance with the manner and purpose of your use.

It is strictly prohibited to use our social media websites to distribute unauthorized copies of copyrighted material.

Repeated breaches of a third party's intellectual property rights may result in your account being banned or blocked from our social media websites. We are entitled to take such measures at our sole discretion. The act of taking or failing to take such measures shall in no case constitute our support for proceedings to be initiated for infringing intellectual property rights. In addition, we hereby retain all our rights not expressly granted in these rules.

Should you publish content on our social media websites, please note that you grant JTI a non-exclusive, global, transferable, sublicensable, royalty-free right to freely use, reproduce, copy, edit, modify, republish, redistribute, or use in any way (for commercial or non-commercial purposes) your post in any media or via any other distribution method. You are responsible for ensuring that you are able to grant us this right.
